Division of competences between EU Member States
Since it is possible to move between EU Member States, it is necessary to separate responsibilities between the different EU Member States in which the transferee will reside and work. Therefore, the legislation introduces the following concepts:

  • First Member State: It is the Member State in which the transferee will reside for a longer period of time than the rest.
  • Second Member State: This is any Member State in which the transferee will reside for a shorter period of time than the First.
The concept of "First Member State" does not mean that the Member State will necessarily be the Member State where the transferee will reside and work first! There may also be more than one Second Member States!
